The use of the Emilio 4.0 Portal (hereinafter also referred to as "Portal") is subject to the following Terms and Conditions. By using or accessing the Portal, you expressly accept the Terms of Use described here. If you do not agree to these Terms, please do not use the Portal.

Access to the Portal and subscription purchase are only allowed to users over the age of 18. Creating an account requires the input of personal data, and each user is responsible for the accuracy and truthfulness of the information provided. For minors, usage is only allowed under the supervision of an adult (parent or legal guardian) or a school supervisor, who must create and manage the student's account.

The Portal provides two types of accounts:

• Supervisor Account: Reserved for responsible adults (parents, guardians, teachers, educational institutions) and allows the management of student accounts. The supervisor account has the ability to:
  • Create and/or delete student accounts;
  • Create and/or delete, as well as manage other Supervisor accounts;
  • Manage subscriptions;
  • Manage and modify profiles associated with accounts.
  Each Supervisor account accesses through a pre-set four-digit PIN, which can be modified and managed in the "Profile" section. The supervisor is responsible for managing and updating the PIN of the associated student accounts.
• Student Account: Intended for minors using the Portal for the purposes defined therein. Student accounts access through a PIN provided by the supervisor. Students can access and use the Portal's features, but cannot modify or manage subscriptions or profiles, unless authorized by the supervisor.

All accounts (both Supervisor and Student) have a customizable profile through the "Profile" section in the Portal. Users can modify their preferences, settings, and view information related to their use of the Portal.

• School Plan: Allows the creation of a Supervisor account (e.g., teacher or educational institution) and multiple student accounts, with a limited number of devices that can be associated.
• Basic Plan: Designed for home use, it includes a limited number of student accounts and one for the supervisor (e.g., parent or guardian), with limited devices.
• Family Plan: Includes more student and supervisor accounts, with more devices that can be associated.

Each plan can be purchased on a monthly or annual basis. The specifications of each plan, including the number of accounts and associated devices, are indicated within the Portal and may vary based on the offer.

Subscriptions can be managed directly from the "Subscription" section within the Portal. Here, the supervisor account can view, modify, or cancel the subscription and manage renewal preferences.

Payments are managed through the Stripe service. By using Stripe, the user accepts Stripe's Terms and Conditions and Privacy Policy, available at the following link: https://stripe.com/it/privacy All subscriptions are paid in advance, and charges occur upon subscription, according to the selected plan (monthly or yearly).

Subscriptions are subject to automatic renewal at the end of the validity period (monthly or yearly). The user can deactivate automatic renewal by accessing the "Subscription Management" section within the Portal at least 24 hours before the end of the current subscription period. No refunds are provided for already purchased subscriptions, in accordance with distance contract regulations (Article 59, letter o, Consumer Code). Cancelling the subscription prevents automatic renewal for subsequent periods but does not entitle the user to a refund for the active period.

The Portal is intended for use by students, including minors. However, registration and subscription purchase must be carried out by an adult. Student accounts can only be created by supervising users (e.g., parents, teachers, or school tutors), who are responsible for overseeing the minor's use of the Portal.

Emilio 4.0 S.r.l. reserves the right to suspend or delete any user account in the case of violation of these Terms and Conditions, applicable laws, or unlawful behavior. Any suspension or deletion will be promptly communicated to the affected user.

The Portal is provided "as is" and Emilio 4.0 S.r.l. does not guarantee that it will be error-free or that the service will not experience interruptions. We are not responsible for any data loss, technical malfunctions, unauthorized access, viruses, or malware that may affect the use of the Portal. The company is also not responsible for any improper use of the Portal by its Users, whether supervisors or students, as each use is personal, as well as any interaction and its legal consequences.

By using the Portal, the user agrees to indemnify and hold harmless Emilio 4.0 S.r.l. from any claims or damages, including legal costs, arising from improper use of the Portal, violation of these Terms and Conditions, or any unlawful behavior. The user also declares, aware of the legal consequences of false statements, the truthfulness and compliance of all information provided for registration and access to the Portal.

All content, features, texts, graphics, and logos within the Portal are protected by copyright, trademarks, and other intellectual property laws. Copying, distributing, or using such materials, even through reverse engineering techniques, is not allowed without the explicit consent of Emilio 4.0 S.r.l.

Emilio 4.0 S.r.l. reserves the right to modify these Terms and Conditions at any time. Users will be informed of any changes via the Portal or email. By continuing to use the Portal, the user accepts the modified Terms.

If any clause of these Terms is deemed invalid or unenforceable, the remaining provisions will remain valid. In case of disputes related to the use of the Portal, the parties agree to attempt an amicable resolution before pursuing legal action.

For any dispute regarding the Portal, the owning company, the involved parties, and the exercise of any rights before the competent authorities, jurisdiction is vested in the Court of Rome.
